Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Agreement

Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Vurbmoto Dreamstakes (the “Sweepstakes”) sponsored by Vurb Dreamstakes, LLC (the “Sponsor”).

By participating in the Sweepstakes, you signify your agreement to these Official Rules and the decisions of the Sponsor and RAVEN5 Ltd. (the “Administrator”). If you do not agree to the Official Rules, you may not enter the Sweepstakes.

2. Sweepstakes Period

The Sweepstakes begins at 9:00:01 AM Pacific Time (“PT”) on March 8, 2024 and ends at 8:59:59 AM PT on June 18, 2024 (the “Sweepstakes Period”). Sponsor’s database clock will be the official timekeeper for this Sweepstakes.

The Sweepstakes consists of one (1) entry period for the Grand Prize (the “Grand Prize Entry Period”) during which entries for the Grand Prize must be received, and seven (7) entry periods for Second Prizes (each, a “Second Prize Entry Period”) during which entries for the applicable Second Prize must be received. Each Second Prize Entry Period has its own start and end date (deadline) and entrants will not be entered for a chance to win any Second Prize after the end of its Second Prize Entry Period (all as further described below in Section 5. Prizes / Approximate Retail Value (“ARV”) / Odds).

3. Eligibility

The Sweepstakes is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. (“Participant,” “entrant” or “you”).

Employees, officers, directors, agents, or representatives, of Sponsor, Administrator, each of their respective parent companies and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Sweepstakes Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each, are not eligible to enter.

The Sweepstakes is subject to all applicable federal, state, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry may be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside the forty-eight (48) contiguous United States and the District of Columbia, and wherever else prohibited by law.

4. How to Enter

There is no purchase necessary to enter the Sweepstakes. Making a purchase will not improve your chances of winning.

1. Purchase Entry:

Eligible entrants who make a purchase on https://shopvurb.com/ (the “Sweepstakes Website”) and confirm their consent to participate in the Sweepstakes during the Sweepstakes Period will receive (1) entry for every $1.00 (USD) spent on an eligible purchase (for example: purchase $100.00 of product from the Sweepstakes Website and receive 100 entries into the Sweepstakes). The number of entries you receive for a purchase will be based on the list price of your eligible purchase (excluding sales tax and shipping charges) and will be rounded up to the nearest dollar. Each eligible entrant entering the Sweepstakes with a Purchase Entry (or Purchase Entries) will be asked to provide his/her consent to participate in the Sweepstakes prior to making his/her first eligible purchase on the Sweepstakes Website.

There is no limit on the number of Purchase Entries an eligible entrant may receive, provided he/she has provided. If a purchase is returned prior to the drawing, any entries associated with that purchase will be voided. Purchase transactions must be received by 8:59:59 AM PT on June 18, 2024 to be eligible to receive entries into the Sweepstakes.

1. No Purchase Required - Mail-In Entry

To enter the Sweepstakes without making a purchase, on a 3”x5” piece of paper, hand print your first and last name, street address, city, state, zip code, date of birth (mm/dd/yyyy), email address and phone number (including area code). Insert the paper into a #10 size envelope with sufficient postage to: Vurbmoto Dreamstakes c/o RAVEN5 Ltd. 10685-B Hazelhurst Dr. # 36740 Houston, TX 77043 USA.

Eligible Mail-In Entries will each receive thirty (30) entries. Mail-In Entries must include all requested information (as stated above) to be considered eligible. Only one (1) Mail-In Entry per mailing envelope will be accepted. Bulk shipments (multiple entries in one shipping package) will not be accepted and will be destroyed.

Submitted Mail-In Entries become the property of the Sponsor and will not be returned. Requests for confirmation of receipt of mail-in entries will not be acknowledged. No photocopies, facsimiles or reproductions of Mail-In Entries will be accepted. Sponsor is not responsible for late, lost, damaged, stolen, incomplete, illegible, postage due, or misdirected entries. Proof of mailing does not constitute proof of delivery.

There is no limit on the number of Mail-In Entries an eligible participant may receive. Mail-In Entries must be postmarked by June 18, 2024 and received by June 24, 2024 to be eligible for the Grand Prize drawing. To be eligible for the Second Prize drawings, Mail-In Entries must be postmarked by the end date (deadline) of the applicable Second Prize Entry Period and received within five (5) days of such deadline.

Bonus Entries – Bonus Entry Multipliers: 

Throughout the Sweepstakes Period, opportunities will be offered to increase the number of entries earned on Purchase Entries or Mail-In Entries by a multiplier, for example, 2x, 5x, 20x (each, a “Bonus Entry Multiplier”). 

When a Bonus Entry Multiplier is offered, entries earned during this time will be multiplied by the applicable Bonus Entry Multiplier. For example, an eligible purchase of $30 during a 2x Bonus Entry Multiplier offer will earn an entrant sixty (60) entries into the Sweepstakes. Timing for each Bonus Entry Multiplier offer will be solely determined by the Sponsor and will be announced on https://shopvurb.com/.

To receive additional entries during a Bonus Entry Multiplier offer without making a purchase, follow the instructions outlined above to complete and submit a Mail-In Entry during the Bonus Entry Multiplier offer. Mail-In Entries that are postmarked corresponding to the dates of a Bonus Entry Multiplier offer and received within five (5) business days of such Bonus Entry Multiplier offer will receive the applicable number of entries for the Bonus Entry Multiplier offered (for example, during a 5x Bonus Entry Multiplier offer an eligible Mail-In Entry will earn 150 entries).

Bonus Entries – Sponsor Event Entry Multipliers:

Throughout the Sweepstakes Period, corresponding with various Sponsor events (each, a “Sponsor Event”), opportunities will be offered to increase the number of entries earned on  Purchase Entries or Mail-In Entries by a Bonus Entry Multiplier of 10x.

To be eligible for a Sponsor Event Entry Multiplier, during the Sponsor Event Entry Multiplier offer, eligible entrants must (i) attend the applicable Sponsor Event or (ii) visit shopvurb.com and follow the online instructions to opt-in to the applicable Sponsor Event Entry Multiplier offer. If eligible for a Sponsor Event Entry Multiplier offer, eligible Purchase Entries or Mail-In Entries received by an entrant during the respective Sponsor Event Entry Multiplier offer will be multiplied by ten (10). Sponsor Events include:

• Gypsy 500 in Mesquite, Nevada. Offer period: 12:00:01 AM PT on March 8 to 11:59:59 PM PT on March 9, 2024.

• World Mini in Mesquite, Nevada. Offer period: 12:00:01 AM PT on April 4 to 11:59:59 PM PT on April 7, 2024.

• Vurbadilla Shred Tour Unadilla, NY. Offer period: 12:00:01 AM PT on May 18, 2024 to 11:59:59 PM PT on May 19, 2024.

• OMC Shred Tour in Boise, ID. Offer period: 12:00:01 AM PT on May 25 to 11:59:59 PM PT on May 26, 2024.

• Vurbapalooza Shred Tour in Washougal, WA. Offer period: 12:00:01 AM PT on June 15 to 11:59:59 PM PT on June 16, 2024.

By entering the Sweepstakes, you signify your agreement to these Official Rules and the Sponsor’s Privacy Policy. Sweepstakes Parties are not responsible for lost, late, stolen, incomplete, inaccurate, invalid, un-intelligible, garbled, delayed or misdirected entries, all of which will be void. Entries which are incomplete, illegible, or fraudulent are null and void.

5. Prizes / Approximate Retail Value (“ARV”) / Odds

One (1) Grand Prize and seven (7) Second Prizes are available to be won, as detailed below in the Entry Period & Prize Description Schedule:

The total ARV of all prizes available is $53,479.00 USD.

Odds of winning the Grand Prize will depend on the total number of eligible entries received during the entire Sweepstakes Period.

Odds of winning a Second Prize will depend on the total number of eligible entries received during each Second Prize Entry Period. 

6. Prize Conditions:

All expenses related to the acceptance or use of a prize are the sole responsibility of each prize winner. Winners are responsible for any and all local, state, federal and/or income taxes, and any other costs and expenses not specified herein as being awarded.

No cash alternative or substitution of a prize will be allowed, except Sponsor reserves the right, in its sole discretion, to substitute prize(s) of comparable value if a listed prize is unavailable, in whole or in part, for any reason. Prizes cannot be transferred or assigned to a third party or redeemed for cash. 

Grand Prize includes destination/freight charges. Grand Prize Winner is responsible for any registration, title, license, and dealer fees, insurance and any other costs and expenses not specified herein as being awarded. Grand Prize Winner is solely responsible for any other costs incurred in claiming, registering, or using the prize, except as specified herein.

Other than the manufacturer’s limited warranty, Sweepstakes Parties do not make, nor in any manner are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any vehicles including but not limited to quality, fitness for purpose or mechanical condition. Grand Prize will be awarded “AS IS” including exact models, color, options and condition. The value of the Grand Prize set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed. Grand Prize Winner must have proof of insurance and a valid U.S. driver’s license from their state or place of residence in the U.S. to take delivery of vehicle; failure to show may result in prize forfeiture and selection of an alternate Winner for the Grand Prize. 

7. Winner Selection

Administrator will select all potential winners by random drawings conducted at Administrator’s offices. Administrator’s decisions are final.

For each Second Prize, one (1) potential winner will be selected from among all eligible entries received during the applicable Second Prize Entry Period in a random drawing to be held on or about the dates specified in the Entry Period & Prize Description Schedule specified in Section 5. Prizes / Approximate Retail Value (“ARV”) / Odds.

For the Grand Prize, one (1) potential Grand Prize winner will be selected from among all eligible entries received during the Sweepstakes Period in a random drawing to be held on or about June 27, 2024.

8. Winner Notification

Administrator will notify all potential winners by email using the email address provided by each potential winner in his/her Purchase Entry(ies)and/or Mail-In Entry(ies).

Potential winners will be notified on or about the dates specified in Section 5. Prizes / Approximate Retail Value (“ARV”) / Odds. If any potential winner cannot be contacted within seventy-two (72) hours of notification, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.

Additional Requirements to Win: each potential winner will become a confirmed winner (each, a “Winner”) after meeting the requirements that follow. Failure to do so will result in disqualification and an alternate winner may be selected by the means set forth above. Each potential winner will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility & Liability / Publicity Release form (the “Release Form”).

In addition, any potential winner selected for a prize valued at or above $600.00 USD will be required to complete and return an IRS W-9 form, which will require additional personal information, including a social security number. Information from the W-9 form will only be used to fulfill Sponsor’s tax obligations in connection with this Sweepstakes and for no other purpose. Winners of a prize valued at or above $600.00 USD will be issued an IRS 1099-MISC form for the value of the prize for the year in which the prize was received.

No one is a Winner unless and until the Sponsor officially confirms him/her as a Winner in accordance with these Official Rules.

Prize Delivery: Prizes will be delivered within approximately 60 days after the Sweepstakes Period. 

9. Publicity

Except where prohibited by law, and pursuant to signed releases (as described above), entry into the Sweepstakes and acceptance of a prize constitutes permission to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, each Winner’s name, city, state, and prize won, as news, publicity or information and for advertising, public relations and promotional purposes without limitation and additional compensation, notification or permission.

Sponsor reserves the right to use any and all information related to the Sweepstakes for promotional, marketing and any other purpose, including online announcements unless prohibited by law.

10. Limitation of Liability

By participating in the Sweepstakes and as a condition of acceptance of a prize, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Sponsor, Administrator, Yamaha Motor Corporation, U.S.A. (“Yamaha”), each of their respective parent companies, and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Released Parties”) from, and against any and all loses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation any and all costs and liabilities of any kind including but not limited to lawyer’s fees), and including, without limitation, any such arising from any act of negligence of the Releases Parties, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting from participation of the Sweepstakes or the awarding, acceptance, use, or misuse of a prize. Winners assume all liability for any injury or damage caused or claimed to be caused by participation in this Sweepstakes or use/misuse or redemption of any prize.

FOR RESIDENTS OF THE STATE OF CALIFORNIA: You acknowledge and agree that your release and waiver extends to the following, the protections of which you explicitly waive:

California Civil Code Section 1542: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.

11. General

Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.

The Released Parties are not responsible for: (i) lost, late, misdirected or damaged entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Sweepstakes.

By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes.

Failure to comply with these Official Rules will result in disqualification from the Sweepstakes. Sponsor reserves the right to permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules. If for any reason this Sweepstakes is not capable of running as planned due to any causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination.

12. Disputes

Except where prohibited, Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Georgia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF. 

13. Privacy

By participating in the Sweepstakes each entrant: (i) grants to the Sponsor and Administrator the right to use his/her personal information provided in connection with the Sweepstakes for the purpose of administering the Sweepstakes, including but not limited to contacting and announcing the winners and coordinating prizes; (ii) acknowledges that the Sponsor may disclose his/her Personal Information to service providers of the Sponsor in connection with any of the activities listed above.

Personal information collected is otherwise subject to the Sponsor’s Privacy Policy available at https://shopvurb.com/policies/privacy-policy. 

14. Winners List Requests

For a written confirmation of the Winners (available after July 10, 2024), send an email to help@raven5.com with the subject line: Vurbmoto Dreamstakes Winners List Request. All requests must be received by August 31, 2024 at 2:59:59 PM ET. Requests received after this time will not be fulfilled.
